Terms of Service for Audilift

Agreement to Terms

By accessing or using Audilift (the "App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Audilift ("we," "us," or "our").

Description of Service

Audilift is a voice-first workout tracking application that allows users to:

• Record workouts via voice input
• Automatically transcribe and parse workout data using AI
• Store and organize workout history
• Track personal records and training progress
• Receive AI-powered workout insights (Premium feature)

The Service is provided as a mobile application for iOS devices and is accessible via our website at audilift.app.

Eligibility

You must be at least 13 years old to use Audilift.

If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian.

By using the Service, you represent and warrant that you meet these eligibility requirements.

Account Registration

To use Audilift, you must create an account by providing:

• A valid email address
• A secure password
• Optional profile information (name, preferred weight unit)

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to terminate accounts that violate these Terms or remain inactive for extended periods.

Subscription and Payment

Free Tier

Audilift offers a free tier with limited features:

• 5 voice recordings per month
• 30-day workout history access
• Unlimited manual workout entry
• Basic exercise tracking

Premium Subscription

Premium features include:

• Unlimited voice recordings
• Complete workout history (unlimited)
• AI workout insights and recommendations
• Personal record tracking and analytics
• Progress graphs and trend analysis
• Export functionality (CSV, PDF)

Pricing

• Monthly subscription: $9.99/month
• Annual subscription: $79.99/year (equivalent to $6.67/month)

Trial Period

• New users may receive a free trial period (duration specified at signup)
• Trial can be canceled anytime before it ends to avoid charges
• If not canceled, trial converts to paid subscription automatically

Payment Processing

• All payments are processed through Apple's App Store
• Billing is handled by Apple according to their terms and policies
• We do not store or process credit card information directly

Automatic Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription in your Apple Account Settings

Refunds

• Refund requests are handled by Apple according to their refund policy
• Contact Apple Support or request a refund through your Apple Account
• We cannot process refunds directly

Price Changes

• We reserve the right to change subscription prices
• Price changes will not affect existing subscriptions until renewal
• You will be notified of price changes at least 30 days in advance

Acceptable Use Policy

You agree NOT to use Audilift to:

Prohibited Activities

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to hack, reverse engineer, or compromise the Service
• Use automated systems (bots, scripts) to access the Service
• Impersonate others or create fake accounts
• Harass, abuse, or harm other users
• Collect or store other users' personal information
• Share your account with others
• Resell, redistribute, or commercialize the Service

Content Standards

• Do not upload offensive, inappropriate, or illegal content in workout notes
• Do not use the Service to store non-workout-related audio
• Do not abuse the voice recording feature for purposes other than workout tracking

We reserve the right to monitor usage and terminate accounts that violate this policy.

Intellectual Property Rights

Ownership

• Audilift and all related trademarks, logos, and content are owned by us
• The app design, code, and proprietary technology are protected by copyright and intellectual property laws
• You may not copy, modify, distribute, or create derivative works without permission

Your Content

• You retain ownership of your workout data and recordings
• By using the Service, you grant us a limited license to:
  • Store and process your data to provide the Service
  • Use aggregated, anonymized data for service improvement
  • Share your data with third-party processors (OpenAI, Firebase) as described in our Privacy Policy
• You can delete your content at any time
• Upon account deletion, we will delete your data within 30 days

Third-Party Content

• Exercise names and terminology are provided for informational purposes
• We do not claim ownership of standardized exercise names
• User-generated content (workout notes, custom exercises) remains the property of the user

AI-Generated Content

Audilift uses artificial intelligence (OpenAI's GPT-4 and Whisper) to:

• Transcribe voice recordings
• Parse workout data from natural language
• Generate workout insights and recommendations

Accuracy

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying all parsed workout data
• We do not guarantee 100% accuracy of transcription or parsing
• Always confirm data before saving workouts

No Medical Advice

• AI insights and recommendations are for informational purposes only
• They do not constitute medical, health, or fitness advice
• Consult qualified professionals before starting any training program
• We are not liable for injuries or health issues resulting from following AI recommendations

User Responsibilities

You are responsible for:

Workout Safety

• Ensuring you are physically capable of performing exercises
• Using proper form and technique
• Training within your abilities and limitations
• Consulting healthcare professionals before starting new training programs

Data Accuracy

• Reviewing AI-parsed workouts for accuracy
• Correcting errors in transcription or parsing
• Backing up important data if desired
• Understanding that we are not liable for data loss

Device Requirements

• Maintaining a compatible iOS device
• Ensuring sufficient storage and internet connectivity
• Keeping the app updated to the latest version
• Protecting your device with passcodes and security measures

Disclaimers and Limitation of Liability

Disclaimer of Warranties

AUDILIFT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding third-party services (OpenAI, Firebase)

We do not guarantee:

• Continuous availability of the Service
• Compatibility with all devices or operating systems
• Accuracy of AI transcription and parsing
• Prevention of data loss or security breaches

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDILIFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions or data loss
• Injuries or health issues resulting from workouts tracked via the Service
• Errors in AI-generated content or recommendations
• Third-party actions or failures (OpenAI, Firebase, Apple)

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS (OR $100 IF GREATER).

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Assumption of Risk

By using Audilift for fitness tracking, you acknowledge and assume the following risks:

Physical Activity Risks

• Exercise and physical training carry inherent risks of injury
• You are solely responsible for your workout safety
• We do not supervise, monitor, or provide medical guidance
• Always warm up, use proper form, and train within your limits

Technology Risks

• AI may misinterpret or incorrectly parse workout data
• Voice recordings may fail or be inaccurate
• Data may be lost due to technical failures
• Third-party services may experience outages

You voluntarily assume all risks associated with using Audilift for workout tracking.

Indemnification

You agree to indemnify, defend, and hold harmless Audilift and its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Injuries or damages resulting from your workouts or training
• Content you submit to the Service
• Your violation of applicable laws

Third-Party Services and Links

Audilift integrates with and links to third-party services:

Service Providers

• OpenAI (voice transcription and parsing)
• Firebase/Google Cloud (data storage and authentication)
• RevenueCat (subscription management)
• Apple App Store (payments and distribution)

We are not responsible for:

• The privacy practices of third-party services
• The availability or performance of third-party services
• Content, products, or services offered by third parties

Your use of third-party services is subject to their respective terms and policies.

Termination

Termination by You

• You may delete your account at any time via the app settings
• Cancel subscriptions through your Apple Account Settings (not through the app)
• Upon deletion, your data will be removed within 30 days

Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activity
• Your account remains inactive for an extended period (1+ years)
• We discontinue the Service (with 30 days notice)

Effect of Termination

• Access to the Service will be immediately revoked
• Subscription fees are non-refundable (subject to Apple's refund policy)
• Your data will be deleted according to our Privacy Policy
• Sections of these Terms that should survive (indemnification, disclaimers) remain in effect

Changes to Terms

We reserve the right to modify these Terms at any time.

Notice of Changes

• Updated Terms will be posted on this page with a new "Last Updated" date
• Material changes will be communicated via email or in-app notification
• Continued use of the Service after changes constitutes acceptance

If you do not agree to updated Terms:

• Stop using the Service immediately
• Delete your account
• Contact us with concerns

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting us at contact@yosha.dev.

If informal resolution fails:

• Disputes will be resolved through binding arbitration
• Arbitration will be conducted by the American Arbitration Association (AAA)
• Arbitration will take place in Provo, Utah
• Each party pays their own costs and fees

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative actions.

Small Claims Court

Either party may bring a claim in small claims court instead of arbitration.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect. Invalid provisions will be modified to reflect the parties' intent to the extent permitted by law.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Audilift regarding the Service. They supersede all prior agreements, understandings, and communications.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor without restriction.

Acknowledgment

BY USING AUDILIFT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY.
